Property Assessed Clean Energy is a financing tool the Texas Legislature created in 2013 under Chapter 399 of the Local Government Code. It is not a business loan. A private lender funds up to 100% of the project — hard costs and soft costs — and you repay it through a voluntary assessment placed on the property, the same way a sidewalk or sewer assessment works.

Because the term can run as long as the useful life of the equipment, typically 20 years or more, the annual payment is usually smaller than the annual energy savings. The project is cash-flow positive from the first year, with no money out of pocket.

El Paso County adopted a county-wide PACE program in 2018, administered by the Texas PACE Authority under the statewide PACE in a Box model. That means uniform documents and an open lender market — and if you own property in more than one Texas jurisdiction, one process covers all of them.

Why owners use it

  • No capital outlay and no personal or corporate guarantee — the assessment is secured by the property, not by you
  • If you sell the building, the repayment obligation transfers with the title to the next owner
  • Covers solar, storage, and resiliency measures alongside HVAC, lighting, controls, insulation, and water conservation — one financing for the whole retrofit
  • Long term means the payment fits inside the savings instead of competing with them

Who qualifies

Privately owned commercial, industrial, agricultural, nonprofit, and multifamily property with five or more units, located in a Texas jurisdiction that has adopted a PACE program. Publicly owned property does not qualify — school districts, cities, and counties use lease-purchase, bonding, or a PPA instead. PACE is a Texas program; it does not apply on the New Mexico side.
